1. Acceptance of Terms

Welcome to SparkSteps. These Terms of Use (“Terms”) govern your access to and use of the SparkSteps platform, including our mobile application, website, and related services (collectively, the “Service”), operated by G&J Family Ventures LLC (“we,” “us,” or “our”).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use SparkSteps.

2. About SparkSteps

SparkSteps is a family-centered task, routine, and motivation support platform designed to help children take small, achievable steps toward daily responsibilities — without pressure, punishment, shame, or behavior enforcement.

SparkSteps is:

• A decision-support system, not a compliance tool
• A confidence-building platform, not a behavior-tracking system
• A calm, predictable experience, not a gamified engagement engine
• A parent-led structure, not a child-driven monetization surface

3. Eligibility

You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to create an account and use the Service. The Service is intended for use by parents and guardians who create and manage accounts on behalf of their households.

Children do not create accounts independently. Child profiles are created and managed by an authenticated parent or guardian within their household.

4. Accounts and Households

4.1 Parent Accounts

When you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access.

4.2 Household Structure

Each household is the primary boundary of authority and data within SparkSteps. A household may contain multiple parent accounts and child profiles. Parents within a household share administrative access to household data, including missions, steps, rhythms, and progress records.

4.3 Child Profiles

Child profiles represent participation, not legal identity. Children do not authenticate independently and do not interact with subscription, billing, or monetization features. You are responsible for the accuracy of the information you provide when creating child profiles.

5. Acceptable Use

You agree to use SparkSteps only for its intended purpose: supporting children with routines, tasks, and motivation in a calm and positive environment. You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service or its systems
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to collect data about other users without consent
• Use automated scripts, bots, or scrapers to access the Service
• Misrepresent your identity or your relationship to a child

6. The Child Experience

SparkSteps is designed around a set of permanent principles that protect the child experience. These principles are reflected in these Terms as commitments to our users:

• Progress is always additive. Tasks are completed, never failed. Points accumulate and never expire. There are no streak losses or negative consequences for inactivity.
• No shame or pressure. The Service does not use shame language, red warnings, urgency mechanics, sibling comparisons, or public progress visibility.
• No child-facing monetization. Everything a child can see, earn, or experience is available in the free tier. Children never see subscription surfaces, feature gates, or advertisements.
• Predictability over gamification. The interface is calm, stable, and low-stimulation. Engagement comes through clarity, not tricks.

7. Subscriptions and Payments

7.1 Free Tier

SparkSteps offers a free tier that includes the full child-facing experience. No features visible to or experienced by children are restricted to paid plans.

7.2 Premium Subscriptions

Premium subscriptions provide additional parent-facing features such as long-term insights, history and export capabilities, advanced mission templates, and data backup. Premium features are entirely invisible to children and never alter the child experience.

7.3 Billing

If you subscribe to a premium plan, you agree to pay the applicable fees. Subscriptions renew automatically unless cancelled before the renewal date. You may cancel your subscription at any time from your account settings.

7.4 Refunds

Refund eligibility is governed by the terms of the platform through which you purchased your subscription (e.g., Apple App Store, Google Play). You may also contact us directly to discuss refund requests.

8. Intellectual Property

The Service, including all content, features, functionality, design, text, graphics, logos, and software, is owned by G&J Family Ventures LLC and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial family use in accordance with these Terms.

“SparkSteps” is a product name of G&J Family Ventures LLC. You may not use our name, logos, or trademarks without prior written permission.

9. Your Content

You retain ownership of the content you create within SparkSteps, including mission names, step descriptions, and reward definitions. By using the Service, you grant us a limited license to store, process, and display your content solely to provide and improve the Service.

We will never use your content for advertising, share it publicly, or use it to train third-party machine learning models.

10. Privacy

Your privacy is fundamental to SparkSteps. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

11. Disclaimer of Warranties

SparkSteps is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

SparkSteps is a decision-support and routine-management tool. It is not a medical device, therapeutic service, or substitute for professional advice from healthcare providers, therapists, or educators. We do not guarantee specific developmental, behavioral, or educational outcomes.

12. Limitation of Liability

To the maximum extent permitted by applicable law, G&J Family Ventures LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or similar issues transmitted through the Service by any third party

13. Indemnification

You agree to indemnify and hold harmless G&J Family Ventures LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service or your violation of these Terms.

14. Termination

You may stop using SparkSteps at any time by deleting your account. We may suspend or terminate your access to the Service if you violate these Terms or if we reasonably believe your use poses a risk to the Service or other users.

Upon termination, your right to use the Service ceases immediately. We will handle your data in accordance with our Privacy Policy, including providing reasonable opportunity to export your data before deletion.

15. Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will notify you through the app or by email before the updated Terms take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which G&J Family Ventures LLC is incorporated, without regard to its conflict of law provisions.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
